Terms of Service

1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the PixoVault iOS app and the pixovault.app website (together, the "Service"), operated by Daniel Radut ("we", "us", "PixoVault"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. Accounts
- You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use PixoVault.
- You're responsible for keeping your account credentials secure and for everything that happens under your account.
- One account per person. Business accounts may eventually support multiple users; until then, please don't share credentials.
- Provide accurate information when signing up. You can edit profile details any time in Settings.
3. Plans, subscriptions, and billing
3.1 Free plan
The Free plan is available indefinitely and includes the same features as Pro, but with usage limits (up to 3 projects and 30 photos total per account). We may adjust free-tier limits over time; we'll communicate material changes to current users.
3.2 Pro subscription
Pro is a subscription billed monthly or yearly through Apple's App Store. Pricing is shown in the app at the time of purchase. Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date in your iOS Settings → Subscriptions.
3.3 Refunds
All purchases are processed by Apple. Refund requests must go through Apple's refund process: support.apple.com/HT204084. We can't issue refunds directly on Apple-processed purchases.
3.4 Cancellation
You can cancel your subscription any time in iOS Settings → Subscriptions or from inside the PixoVault app (Settings → Plan & billing). Your Pro access continues until the end of the billing period you paid for. Your data stays in your account.
4. Acceptable use
You agree not to:
- Upload content that's illegal, infringes others' rights, or violates anyone's privacy.
- Attempt to access other users' data, reverse-engineer the Service, or interfere with its operation.
- Use the Service to send spam or harass anyone.
- Resell, sublicense, or rent the Service to third parties.
We may suspend or terminate accounts that violate these rules.
5. Your content
- You own it. The photos, project details, notes, and other content you upload to PixoVault remain yours.
- License to operate the Service.You grant us a limited license to host, store, copy, and display your content solely to provide the Service to you (and, if you use the portfolio sharing feature, to display the content you've explicitly chosen to share publicly).
- You're responsible.You're responsible for your content, including any third-party rights (e.g. photos you took at someone else's property, with their permission).
6. Service availability
We work to keep PixoVault running reliably, but we don't guarantee uninterrupted access. Outages, maintenance windows, and bugs happen. We're not liable for losses caused by Service interruptions, but we do try to minimize them.
7. Account deletion
You can delete your entire account in Settings → Delete account, or by emailing hello@pixovault.app. Account deletion permanently removes your projects, photos, profile data, and subscription records from our active systems within 30 days. Backups age out within 90 days. We're required to retain certain records for legal/tax purposes after deletion; those are de-identified where possible.
8. Disclaimer of warranties
PixoVault is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the extent permitted by law, we disclaim all warranties.
9. Limitation of liability
To the maximum extent permitted by law, PixoVault and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or lost data — arising out of or related to your use of the Service. Our total liability for any claim under these Terms is limited to the amount you paid us in the 12 months preceding the claim.
10. Changes to the Service or these Terms
We may update PixoVault and these Terms over time. Material changes to the Terms will be announced via in-app notice or email. Continued use of the Service after changes take effect means you accept the updated Terms. If you don't accept, please stop using the Service and delete your account.
11. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. Disputes will be resolved in the state or federal courts located in Gwinnett County, Georgia.
